AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and hirogato.com (operated by The Pink Lizard Company Limited, Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong S.A.R, Businesse reg No. 74182969-000 )   concerning your access to and use of the https://hirogato.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only.

PRODUCTS

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

PURCHASES AND PAYMENT

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. All Prices, even those shown in other currencies are based on USD. Depending on the country you are ordering from import duties may apply.  Handling the import to the items is your responsibility, however we are here to help and please feel free to contact us if you need help.

We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

PRODUCTION

All products are made to order, with the exception of pantyhose, which are usually held in stock. We do not maintain stock for any other products. Each made-to-order item is produced individually after an order has been placed. Working days are defined as Monday to Friday, excluding public holidays in our country of operation. Shipping vs. Production Selecting express or priority shipping affects shipping transit time only. It does not reduce, accelerate, or otherwise affect production time. All orders follow the same production timelines regardless of the shipping method selected. Production Times by Product Category Bodywear Line (Catsuits, Leotards, Unitards, Leggings): 10–12 working days Swimwear: 6–8 working days Neoskin Line (Catsuits and Bodies): 16–20 working days (due to the specialized hand screen-printing process) Multiple-Item Orders If an order contains more than one product and all items are shipped together in one parcel, the overall production time for the order will be determined by the item with the longest production time. Peak Season Notice During peak season, from mid-November to mid-January, production times may be extended by up to 5 additional working days due to increased order volume. Production times are estimates and begin after payment has been successfully received.

SHIPPING & TRANSIT TIMES

Unless otherwise stated, all items are shipped from our manufacturing/fulfilment site. With the exception of pantyhose, all products are made to order. Production times are outlined in the Production clause and must be added to the estimated shipping time. Shipping times vary depending on the selected shipping method and destination. All delivery times are estimates only and are not guaranteed. Estimated shipping times can be found here. Please note that these estimates are solely based on our experience with the shipping carrier and may be subject to delays beyond our control. Once an order has been dispatched, no changes, cancellations, or rerouting requests can be made. From this point onward, the shipment is handled entirely by the selected parcel service, and delivery timing is outside of our control. For economy shipping, it is normal for tracking information to show no updates for 8–10 working days while the parcel is in transit. This does not indicate that the shipment is lost or delayed. To help ensure smooth delivery, customers are strongly advised to include a valid recipient phone number during the checkout process. We are unable to add delivery instructions or remarks (such as door codes or “leave at location” requests) to the outside of the parcel. Providing a phone number allows the courier to contact the recipient directly if required.

RETURN POLICY

Please be advised that, unless faulty, we cannot accept returns for our made to order garments, such as catsuits, leotards, unitards or leggings. These items are highly customisable and thus can not be resold, which is why we do not offer returns, for these items, unless faulty. Items that have been sent back to us due to wrong address, not accepted, not picked up or returned due to unpaid import charges are not refundable. In these cases we offer to ship the goods again at the customers expenses. Pantyhose and Swimwear are not returnable for reasons of hygiene. Free One-Time Exchange: If you ordered the wrong size and are concerned about returns, here’s what you need to know: Usually, we don’t accept returns as our items are custom-made to customer specifications. However, we understand that it’s challenging to get the size right on the first try. For first-time customers, we generally allow a one-time exchange for a different size. Please understand that items cannot be reconfigured for an exchange. Definition of a faulty item: An item is considered faulty if it has a defect or damage that was present at the time of delivery. An item is not considered faulty if it has been damaged while being tried on, does not fit due to incorrect size selection, or does not fit due to incorrect or inaccurate measurements provided by the customer. Items damaged through misuse, negligence, or alteration after delivery are not considered faulty. Variations in color, texture, or appearance that occur due to lighting conditions, photography, or differences in monitor or screen settings are normal and do not constitute a fault. When crafting made-to-measure clothing from elastic fabrics, specific percentages are deducted from the customer’s measurements at particular body parts to account for the fabric’s elasticity. Consequently, the finished garments will be smaller than the initial measurements provided. This adjustment is a standard practice and does not indicate any fault in the item. Returns of faulty items: If you have received a faulty item in your order, we apologise for any inconvenience caused. Please contact our customer service team within 7 days of receiving your order, and they will be happy to assist you with the return process. Returns that meet our policy are eligible for refunds in the original form of payment or Store Credit. Store Credit cannot be exchanged into cash or converted into a credit card refund. Shipping costs are non-refundable.

Product Safety and Usage
Our products are designed for their intended use only. Customers are responsible for using all items safely and in accordance with any care or usage instructions provided.

Warnings and Safety Information
Some products may include hoods, including fully enclosed face hoods. These items may restrict vision, breathing, or airflow and must be used with extreme caution. Such products are not suitable for prolonged wear, physical exertion, or any situation where unrestricted breathing or visibility is required.

Products must never be worn while sleeping, under the influence of alcohol or drugs, or in situations where the wearer may be unable to remove the item independently. Use of these products is entirely at the customer’s own risk.

Limitation of Responsibility
We accept no responsibility or liability for injury, discomfort, breathing difficulty, allergic reactions, misuse, or any adverse effects resulting from the use, improper use, or modification of our products. Customers are solely responsible for ensuring that a product is suitable for their personal use, health condition, and environment.

Care and Maintenance
Products should be cleaned and maintained strictly according to the care instructions provided. Improper care or alteration may compromise product safety and performance.

Age Restriction
Our products are intended for adult use only and are not suitable for children.

LIMITATION OF LIABLILITY
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of our website or the purchase of our products. Our total liability for any claim related to an order shall not exceed the amount paid for the product(s) in question. GOVERNING LAW
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles.
